Terms of Service

These terms are the agreement between you and Keen. They cover what you can expect from us, and what we ask of you. We've kept them as plain as we can, so please read them before using the app.
Keen is operated under ABN 39 867 349 188, based in Melbourne, Australia ("Keen", "we", "us", "our"). By creating an account or using Keen, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Keen.
1. Who can use Keen
You must be at least 16 years old to use Keen, and you must give us accurate information when you sign up (including a real mobile number and a date of birth that confirms you meet the age requirement). Keen is currently available in Australia.
2. Your account
You sign in with your mobile number and a one-time code. You're responsible for keeping access to your number and account secure, and for everything that happens under your account. Keep one account per person, and don't impersonate anyone else. Tell us straight away if you think someone else has accessed your account.
3. What Keen does, and doesn't
Keen helps you and your friends find nights you're all free and things on near you worth heading out for. We suggest matches and let you make plans, invite mates, and chat about them.
Keen is a tool to help you organise. It doesn't run events, sell tickets, or guarantee that anyone will show up, that an event will go ahead, or that a plan will happen. Those are up to you, your friends, and the event organisers.
4. Being a good Keen user
Keen only works if people treat each other well. When you use Keen, you agree not to:
- harass, threaten, bully, or abuse other users;
- impersonate anyone, or misrepresent who you are;
- send spam, or use Keen to advertise or promote unrelated products or services;
- post or share content that is illegal, hateful, discriminatory, sexually explicit, or otherwise harmful;
- collect or scrape other users' information, or access Keen using bots or automated means;
- try to break, overload, reverse-engineer, or interfere with the app or its security;
- use Keen to do anything unlawful, or to encourage others to.

Keen has zero tolerance for child sexual abuse and exploitation. See our Child Safety Standards for the standards we follow and how to report a concern.
5. Meeting up is your call, so stay safe
Keen helps you plan to meet people in the real world, including friends and friends-of-friends. We don't verify users' identities or background-check anyone. You are responsible for deciding who you spend time with and for your own safety when you meet up. Use good judgement, meet in public where sensible, and look out for each other. To the extent permitted by law, Keen isn't responsible for what happens between users, online or in person.
6. Your content
You keep ownership of the content you create in Keen: your plans, messages, photos and profile. By posting it, you give Keen a non-exclusive licence to host, store, display and share that content as needed to run the service (for example, showing your plan and messages to the mates you've invited). This licence ends when you delete the content or your account, except for copies that remain in backups for a limited time or that we must keep by law.
You're responsible for the content you post, and you confirm you have the right to post it. Don't post anything that infringes someone else's rights or breaks these terms.
7. Events and third-party content
Event listings, images, times, prices and venue details in Keen are sourced from third parties, such as ticketing platforms and venue listings. We do our best to keep them accurate but we can't guarantee they are, and details can change or events can be cancelled. Buying tickets and attending events is a matter between you and the relevant organiser or ticket seller, under their terms. Keen isn't responsible for third-party events, websites, or content.
8. Notifications and SMS
To sign you in, we send a one-time code by SMS, and standard message rates from your carrier may apply. When you use Keen, we also send push notifications (matches, invites, RSVPs, messages and friend requests). You can control notification categories in the app and turn them off in your device settings.
9. Early software and availability
Keen is new and developing. We may add, change, suspend or remove features at any time, and the app may occasionally be unavailable or contain bugs. We provide Keen on an "as is" and "as available" basis.
10. Our intellectual property
Keen, including the app, the "Keen" name and logo, and its design and software, belongs to us. We give you a personal, limited, non-transferable licence to use Keen for its intended purpose while you comply with these terms. You don't get any other rights to our brand or software.
11. Suspending or ending your account
You can delete your account at any time in the app (Me tab → account settings → delete account). We may suspend or end your access to Keen if you breach these terms, misuse the service, or where we reasonably need to protect Keen or its users. Sections that by their nature should survive (such as content licences already granted, disclaimers and limitations of liability) continue to apply after your account ends.
12. Disclaimers and your consumer rights
Nothing in these terms excludes, restricts or modifies any rights or guarantees you have under the Australian Consumer Law or other laws that cannot be excluded. Those rights always apply and take priority over anything in these terms.
Apart from those non-excludable rights, and to the extent permitted by law, Keen is provided without warranties of any kind, and we don't guarantee that matches, plans or the service will meet your expectations or be uninterrupted or error-free.
13. Limitation of liability
To the extent permitted by law, Keen is not liable for any indirect, incidental or consequential loss, or for loss arising from events, other users, or things outside our reasonable control. Where our liability can't be excluded but can be limited, our liability is limited to re-supplying the service (or the reasonable cost of doing so). Again, this does not limit any rights you have under the Australian Consumer Law.
14. Governing law
These terms are governed by the laws of Victoria, Australia, and you and Keen submit to the courts of Victoria.
15. Changes to these terms
We may update these terms as Keen grows. We'll post the new version here and update the date at the top. If the changes are significant, we'll let you know in the app. Continuing to use Keen after a change means you accept the updated terms.
